Sharcon Media s.r.o. runs digitamind.com website (in text “Website”) and all services (“Service”) connected to the Sharcon Media s.r.o. These Terms and Conditions address specifically the access and use of the service. By purchasing and/or accessing the aforementioned service you comply expressly with the Terms and Conditions specified herein.
An on-going membership is provided at digitamind.com. Your membership is automatically renewed following a trial period of 3 days, and then again, every membership cycle depending on your chosen membership. See our “Pricing Plans” section for all membership and currency information. Memberships run automatically until you actively cancel your membership. No binding period applies, which means it can be terminated at any time. When signing up for a membership through any of our ongoing campaigns you agree to let digitamind.com cancel the promotional trial period price and charge the regular 14 day subscription rate from the credit card that was used when signing up for the service. When purchasing a subscription, it will automatically be renewed every 14 day until you decide to terminate it. To own a valid subscription on digitamind.com you must be at least 18 years old and be a resident in one of our operating countries. No hidden fees will be charged when signing up and you can terminate the subscription at any moment before the end of the 3 day trial period. Should the customer’s credit card reject the subscription charge, the same credit card will later be charged the same amount until payment is registered successfully. Continuous rejected payments that last over 6 months will result in immediate subscription termination and access to digitamind.com will be closed. Sharcon Media s.r.o. reserves the right to issue both digital and physical invoices if an order is not completed through credit card payment. Invoices may be issued by a third party in accordance with Sharcon Media s.r.o.’s legal right to use so called factoring methods. The customer also understands and accepts that in this agreement all electronic and telephonic communications between the mentioned parties are in accordance with RPL § 154a. An order and payment confirmation will be sent to the email stated by the customer upon registration.

We strive to provide the very best customer support available 24/7 all year round. We will do our best to offer guidance and support within 24 hours every day all year round. We provide assistance in English and other languages using different online translation services, so please send us your questions in your desired language. That way we will be able to offer the best and quickest assistance online. If queries are sent in other languages than English we might not be able to assist you. digitamind.com is not to be held accountable for the loss or inability to receive e-mails, invoices, receipts, terminations and other important messages on behalf of the subscriber. It is the sole responsibility of the subscriber to provide a legitimate and fully functional e-mail address that can ensure all e-communications on behalf of digitamind.com are received, read and not sent to the spam or ”junk mail” folder. E-mail providers such as Hotmail and Gmail are less reliable when it comes to acknowledging e-mails issued by digitamind.com. Therefore we recommend using an alternative provider when signing up to digitamind.com.
Payment & Billing
You have the sole responsibility of ensuring that your payment information is correct. You agree to pay in advance for the services provided and ahead of the time period in which said services are provided. Unless otherwise stated, you agree to be billed automatically in order to prevent any disruption of your Services. Payment will be made with the use of your credit card or other billing solutions provided by you and kept on file with us, until you notify Sharcon Media s.r.o. of your desire to cancel your Services.
The prices of the trial period are 2€ or 9.95€ for 3 days depends on package, but the Sharcon media s.r.o reserves the right to conduct promotional campaigns for selected regions, countries, and user groups and provide a trial at a price of €2.95 or €14.95 If a customer remains subscribed beyond the trial period, will automatically update to the Basic Package at 19.99 € / 14 days, the Advanced Package is renewed at 29.99 € / 14 days and the Premium Package at 49.99 € / 14 days .
Sharcon Media s.r.o. does not store payment information. All payments are made through SSL encryption technology in order to ensure maximum safety. You acknowledge and accept that any card and/or related billing and payment information provided by you will be shared by Sharcon Media s.r.o. with a third party associate, such as: payment processor and/or other payment processing services. If you do not cancel your subscription by the time your trial period expires, your card will be charged the corresponding amount which is specified in our “Pricing Plans”.

Sharcon media s.r.o reserves the right to provide with the Basic Package for 6 weeks for 54.99 € , the customer also has the opportunity to purchase the Advanced Package for 6 weeks for 74.99 € , there is also the option to purchase a Premium Package for 6 weeks for 94.99 €. Also, you can order access to a Premium Package for €149.99 for annually.
We will send you an email with this offer after the trial period begins, and you will have the opportunity to connect this membership.
Cancellation
You may terminate or cancel your service by sending a written notice to digitamind.com via email: [email protected]. You have the right to discontinue and/or cancel your account and/or any digitamind.com Services at any time. Please note that your subscription can also be paused for an unlimited period of time due to travel/vacation or other reasons. For further enquiries please include the following information: order number, customer ID, full name and email-address. You can cancel your subscription at any time. However, your profile will still remain active until the next billing period starts. After that, you will no longer be able to access your profile and we will delete all personal information stored on your profile. We shall not be held responsible for such deleted information.
Delivery Policy
You will receive login credentials per email, included in the welcome email with instructions to where you will login. Your delivery of the product is instant upon purchase, which constitute delivery to you of the item(s) you have purchased through us.
When you receive the email with login credentials to login to our platform, the receipt by you of the email will constitute as a delivery by us to you of the item(s) you have purchased.
In case you have not received the emails including the login credentials of your purchase, or the email with the receipt for your item(s), you must make contact to us within 3 working days from the initial date of the order of the item(s). If you do not contact us within the constituted time frame of 5 working days from your initial purchase of your item(s), then it will be considered as the item(s) have been received to the rightfully purchaser, and therefore delivered to you correctly.
Termination
digitamind.com can decide to terminate your access to its Services, in full or in part, without prior notice, in the event that:
- You should violate this Agreement
- You should fail to pay your fees in a timely fashion
- You should abuse or use the Service in a way that may harm Sharcon Media s.r.o. or others
- You should violate our Terms & Conditions and/or share other customer’s information (e-mail address, postal address, telephone number, etc.)
- You should demonstrate illegal, non-ethical, irresponsible or harmful behavior that may be interpreted as harassment towards other customers or thecom website. Your account should be considered fraudulent.
- You should engage in unacceptable behavior as defined by our website.
In such case, digitamind.com will not refund any fees paid by you prior to termination, and you will be obligated to pay any fees and charges prior to the effectiveness of said termination.
Please note: Upon Service termination, user content, profile, and related data will be deleted. Your account and the use of our Service will be terminated, either by you or by Sharcon Media s.r.o. You can terminate your subscription by following the instructions provided by the Service. Sharcon Media s.r.o. has the right to terminate your access to the Service at any moment and for any reason, thus canceling your right to the further use of the Service. You may terminate your digitamind.com account at any time by following the instructions provided by the Service. These Terms and Conditions regarding the protection and enforcement of digitamind.com proprietary rights, your representations and warranties, the disclaimer of representations and warranties, release and indemnities, liability restrictions and any types of damages, data and information ownership, governing law and jurisdiction, as well as miscellaneous provisions will survive any such termination. Content considered a direct violation of the law and cases of harassment shall be reported to the relevant authorities, including the member’s IP address, time of creation and other relevant information.
Refunds
In case you decide to cancel your subscription within 3 days from subscribing. Refund requests will be reviewed by our customer support team. We will process refund the corresponding amount to your credit card. We offer a full refund of last subscription costs.
Inappropriate Use
You are not allowed to upload, display or in any other way provide through or on our Service any content that: (i) is defamatory, libelous, abusive, threatening, discriminating, harassing, offensive or in any other manner violates the law or infringes upon the rights of a third party (this includes copyright, privacy, trademark, publicity and/or other personal or proprietary rights); or (ii) Sharcon Media s.r.o.’s sole judgment, is objectionable or restricts/inhibits any other person from using the Service and/or may potentially expose Sharcon Media s.r.o. or its users to any harm of any kind.
Indemnification Of Sharcon Media s.r.o.
You agree to indemnify Sharcon Media s.r.o. and its directors, employees, agents, contractors and suppliers for any losses, claims, liabilities and damages, including attorney’s fees, that should arise from your access to or use of the Service, including any false representation made to the Sharcon Media s.r.o., your violation of any of these Terms and Conditions, and/or claims that any product provided by us is inaccurate, inappropriate and/or defective in any way.
Obligations and Warranties
You will ensure Sharcon Media s.r.o. that your access and use of our Service is in accordance with these Terms and Conditions and all laws, rules and regulations applicable within the EU or any other relevant jurisdiction, including those with regards to online behavior and acceptable content, and those which concern the transmission of data exported from the EU and/or the jurisdiction in which you reside. You further warrant that you are the sole proprietor and/or creator of any material submitted through the Service or/and that you have the right to exploit such material as detailed below. You will also make sure to keep your user name, password and account information safe. Access and use of the service may be restricted, limited or unavailable during system upgrades, periods of heavy demand, malfunctions or scheduled/unscheduled maintenance as well as other reasons.
Damages and Liabilities – Limitations
Sharcon Media s.r.o. will not be held liable for any incidental, special, indirect, consequential or exemplary damages that might arise out of the access or use of the Service, or due to the inability to access or use the Service or any parts thereof, which includes but is not limited to the loss of use of the Service, unsatisfactory or inaccurate results, profit loss, interruptions or damages caused by the loss or corruption of data or information, or data being rendered inaccurate, the cost of recovering such lost data, the cost of substitute services or claims made by third parties for damages to computers, modems, software, telephones or any other related property, even if Sharcon Media s.r.o. has been informed of the possibility of such damages. Sharcon Media s.r.o.’s liability to you or to any third party acting and/or claiming on your behalf is limited to the amount paid by you for the service in the 12 months prior to the initial action that gave rise to the liability, regardless of the form of the action. This is an aggregate limit. The existence of more than one claim does not increase the limit. The software used on digitamind.com’s website may possibly have technical, typographical, or photographic errors. digitamind.com does not guarantee that any material on its website are accurate, complete or up-to-date. digitamind.com may change the content on its website at any time without prior notice. digitamind.com does not, however, guarantee that updates will be made to the materials. Furthermore, no refunds will be paid out if and when our software is out of service. We will of course do our best to provide the best service possible for all our subscribers. digitamind.com has not reviewed all of the sites/links/url’s connected to its website and is not responsible for the contents of any such linked sites, or the content and/or files uploaded by our users on digitamind.com. Inclusion of links or files on our website does not imply endorsement by digitamind.com. The use of any linked content is at the user’s own risk.
Proprietary Rights Regarding Content And Materials
Any content available through our Service, including designs, graphics, texts, images, data, software, audio and other related files, as well as their selection and arrangement (i.e. “Service Content”), are the sole property of Sharcon Media s.r.o. and/or its licensors. digitamind.com and all other trademarks, including service marks, logos and graphics used through the Service or in connection to the Service are the property of Sharcon Media s.r.o. Some of them have been registered with the EU Copyright Directive. Cancellations and Opt-Outs
Members and subscribers who have chosen to receive our notification and/or marketing emails may opt out at any time by clicking the “unsubscribe” link at the bottom of our e-mails. Requests to unsubscribe can also be made by emailing us directly using the contact information provided. Governing Law and Arbitration

Disputes that may arise between you and Sharcon Media s.r.o. are to be resolved by means of binding arbitration. Arbitration is to be conducted by a single arbitrator in the Czech Republic. Unless expressly required by law, each party is responsible for its own legal costs and attorneys’ fees regardless of which party is considered the prevailing party in the arbitration.
Claims Of Copyright Violations – Notices
In order to prove and demonstrate claims, as a copyright owner, of infringement upon your copyrights in connection to the use of any materials available in the Service, you can submit a copyright infringement notification to digitamind.com pursuant to the EU Copyright Directive. In doing so, you will provide us with the following documentation:
- A physical or electronic signature of the copyright owner or the person acting on behalf of the copyright owner;

Should you at any point in time fail to comply with these laws, digitamind.com reserves the right to terminate your account without prior notice.
Changes In Terms And Conditions
Sharcon Media s.r.o. reserves the right to modify these Terms and Conditions at any time. If the Terms and Conditions should change we will publish it on our website, allowing the subscriber 30 days to cancel the subscription should you disagree with said terms. Subscribers who have not terminated their accounts after 30 days will be considered in compliance with the changes in our Terms and Conditions. Subscribers can at any time change their user information in the ”My profile” section.
Miscellaneous
These Terms and Conditions include the full agreement between digitamind.com and you as a subscriber. In the event that any of these Terms and Conditions are considered unenforceable by a court or any other tribunal of competent jurisdiction, such provisions shall be limited to the minimum extent necessary for these Terms and Conditions to remain in full force and effect. A waiver by Sharcon Media s.r.o. or you of any one provision set out in these Terms and Conditions will not eliminate such term or condition or enable a breach thereof. These Terms and Conditions are binding and to the benefit of Sharcon Media s.r.o. and you, as well as to yours and Sharcon Media s.r.o.’s respective successors.
Language
These Terms and Conditions have originally been written in the English language (US). In the event that any translated version of this agreement should conflict with the original English version, the English version shall prevail.

Complaints are handled by the support team and escalated in the organization if required. The customer shall be informed about the state of the complaint to a reasonable level.
